«Desalojo inmediato» de Dolores Etchevehere del campo ordenado por la justicia de Entre Ríos
La decisión fue comunicada por la jueza Maria Carolina Castagno del tribunal de Apelación de Paraná.
La jueza María Carolina Castagno, del tribunal de Apelaciones y juicio de Paraná, ordenó desalojar a Dolores Etchevehere del campo en disputa con los hermanos Etchevehere, luego de encabezar este miércoles una audiencia en la que escuchó a todas las partes. De esta forma falló a favor del ex ministro de Agroindustria y presidente de la Sociedad Rural, Luis Miguel Etchevehere.
«Al haberse demostrado en el grado de provisoriedad que requiere una medida cautelar, que los sindicados han invadido el inmueble en cuestión despojando a quienes detentaban la posesión del predio. A saber: las margaritas S.A. Carece de toda relevancia la discusión del título de propiedad o el estadio procesal del estado de posesión», leyó Castagno.
«Procedencia de la cautela interesada. A saber: el reintegro inmediato del establecimiento rural identificado como Casa Nueva», decidió Castagno, quien pidió identificar a los ocupantes y desalojar el campo sin que haya heridos. El fallo fue seguido desde un celular en la puerta del campo por los hermanos Etchevehere, la ex ministra de Seguridad, Patricia Bullrich y Leonor Etchevehere, la madre de Dolores.
La decisión concentró la expectativa, luego de que las protestas de productores agropecuarios y el apriete de los medios hegemónicos de comunicación que publicaron perfiles de la jueza. «Espero ahora que mi hija acate el fallo como va a ser y nos demos un abrazo», afirmó Leonor Etchevehere en el ingreso al campo.
En la audiencia que tuvo lugar en Paraná, la Fiscalía y la querella ratificaron el pedido de desalojo, en tanto que la defensa de Dolores Etchevehere se expresó por mantener su permanencia en Casa Nueva, La Paz.
Los primeros en hablar en la audiencia fueron los fiscales Oscar Sobko y Mónica Carmona, quienes reiteraron el pedido de desalojo. En ese sentido, afirmaron que Dolores cometió «daño a la propiedad, abuso y engaño» cuando con 40 desconocidos tomó el campo el pasado 15 de octubre.
Para el fiscal Sobko, el dueño del campo es la sociedad anónima Margaritas que tiene como presidenta a Leonor, madre de los cuatro hermanos Etchevehere. Explicó, además, que Dolores tenía que tener la autorización de la autoridad máxima de la sociedad para ingresar y «no la tuvo».
Por su parte, el abogado de Dolores, Lisandro Mobilia, insistió en que la mujer cedió las acciones del campo bajo extorsión y hasta cuestionó al escribano que dio fe de ese acto, por el cual los hermanos justifican la posesión del campo.
Además, criticó a los fiscales, al asegurar que en casos anteriores ellos dirimían este tipo de conflictos en la justicia civil y no lo penalizaban como lo hacen en este caso.
