Santiago Maldonado: Reabren la causa para investigar si hubo abandono de persona
El Tribunal Federal de Apelaciones de Comodoro Rivadavia resolvió reabrir la causa por la muerte de Santiago Maldonado que había archivado el juez Gustavo Lleral. Si bien este negó que haya existido el delito de “desaparición forzada de persona”, dejó abierta la posibilidad de que uno o más gendarmes, como así también algún miembro de la comunidad mapuche, hayan abandonado al manifestante en las aguas del río Chubut.
“Consideramos que se investigó una única hipótesis delictiva, aquí definitivamente descartada, sin que haya sido objeto de valoración y pronunciamiento algún posible nexo causal entre cualquier omisión de personal e gendarmería o de quienes se introdujeron en el rio con Maldonado”, expresa el fallo de 15 páginas, según informó C5N.
La Cámara decidió revocar la resolución del juez federal de Rawson y ordneó avanzar con una serie de medidas de pruebas tendientes a determinar con precisión las circunstancias en las que se produjo la muerte de Maldonado.
La Cámara hizo hace lugar a un pedido de la familia Maldonado de que no se cerrara la causa. Según testigos, Santiago intentó cruzar el rio aunque no sabía nadar y en medio e una persecución perpetuada por Gendarmería, murió ahogado.
